These Terms of Service ("Terms") govern your access to and use of nexarina.com and any products or services offered by Nexarina ("Nexarina," "we," "us," "our"). By visiting our site or purchasing from us, you agree to these Terms and to any policies referenced here, including our Refund Policy, Shipping Policy, and Privacy Policy. If you do not agree, please do not use our site.

1) Eligibility & Acceptance

  • You must be at least the age of majority in your province, state, or country of residence, or have the consent of a parent or legal guardian.
  • You represent that you have the legal authority to enter into these Terms.
  • We reserve the right to refuse service, cancel orders, limit quantities, or restrict accounts at our discretion, including in cases of suspected fraud, abuse, resale activity, or policy violations.

2) Pre-Orders & Release Window

Many Nexarina products are sold via pre-order. By placing a pre-order, you agree to the following:

  • Estimated ship window: Pre-order timelines are estimates only and may change due to production, supplier, freight, customs, or manufacturing delays.
  • No guaranteed ship date: Estimated ship windows are not guaranteed and do not automatically entitle the customer to compensation, discounts, cancellation, or damages beyond what is required by law.
  • Minimums: Some styles, sizes, or colorways may require minimum order thresholds to proceed. If a product does not meet the required threshold, we may cancel that item and issue a refund or offer an alternative.
  • Changes/Cancellations: You may request to modify or cancel a pre-order before production begins by emailing info@nexarina.com. Once production has started, changes or cancellations may not be possible.
  • Unavailable items: If an item becomes unavailable, delayed beyond viability, or cannot be fulfilled, we may issue a refund or offer an alternative.

3) Product Information, Pricing & Availability

  • We strive to display product colors, materials, and details as accurately as possible, but we cannot guarantee that your device or screen will display colors exactly.
  • Prices, product descriptions, specifications, imagery, and availability may change without notice.
  • We reserve the right to limit or cancel orders by person, household, address, payment method, or account.
  • We reserve the right to make non-material changes to products, packaging, trims, labeling, or components where reasonably necessary, provided such changes do not materially affect the core function, fit, or intended use of the product.
  • In the event of a pricing, product description, or inventory error, Nexarina reserves the right to correct the error and cancel or refuse any affected order, even after payment has been submitted. If payment has already been processed, a refund will be issued.

4) Promotions, Discounts & Offers

  • Promotions, discount codes, and special offers are subject to change or cancellation at any time and may not be combined unless explicitly stated.
  • Nexarina reserves the right to refuse or cancel orders where promotions, discounts, or codes have been misused, duplicated, or applied in error.

5) International Orders, Duties & Taxes

  • International customers are responsible for all customs duties, tariffs, import taxes, brokerage, handling fees, and other import-related charges assessed by the destination country and/or carrier.
  • These charges are not included in our product prices or shipping rates unless explicitly stated at checkout.
  • Customs inspections, import processing, or carrier handling may cause delays outside of our control.
  • Refused shipments: If an international order is refused due to unpaid duties, taxes, tariffs, brokerage, or import fees, any refund issued will be less all non-recoverable shipping, customs, brokerage, return to sender, carrier, and administrative charges incurred as a result of the refusal.

6) Orders, Payment & Billing

  • By placing an order, you authorize Nexarina to charge the payment method provided for the full amount of your purchase, including any applicable taxes and shipping charges.
  • You agree to provide current, complete, and accurate billing, shipping, and contact information.
  • We reserve the right to contact you to verify order information, confirm identity, or resolve issues that may affect fulfillment.
  • If a chargeback or payment dispute is initiated in relation to an order, Nexarina reserves the right to suspend further fulfillment, returns, exchanges, or customer support on that order until the matter is resolved.

7) Shipping, Delivery & Risk of Loss

  • Shipping and delivery timelines are estimates only and are not guaranteed.
  • Delays caused by production, carriers, customs, weather, or events outside our control do not constitute grounds for cancellation, refund, or damages beyond what is required by law.
  • Title and risk of loss for products pass to the customer upon transfer to the shipping carrier, subject to applicable consumer protection laws.

8) 60-Day Fit Trial, Returns & Exchanges

Your satisfaction matters. In addition to our Refund Policy, Nexarina offers a 60-Day Fit Trial on eligible apparel:

  • 60-Day Fit Trial: Try your gear for up to 60 days from delivery. If it is not the right fit, you may request a return or exchange subject to the conditions below and our Refund Policy.
  • Condition: Items must be clean, undamaged, and free of excessive wear, including no rips, stains, odors, pet hair, or alterations. Please include all components, such as belts or removable parts, and, when possible, original packaging and tags.
  • Exchanges: Free exchanges may be offered subject to stock availability and region.
  • Returns for Refund: Return shipping policies may vary by region and will be disclosed during the return request process.
  • Defective/Damaged on Arrival: Please contact us within 7 days of delivery with photos so we can assist.
  • Exclusions: Final sale items, heavily used items, unauthorized returns, and products returned in unsellable condition may be ineligible for refund or exchange.

9) Limited Warranty & Disclaimers

  • Limited Warranty: Nexarina products are warranted against manufacturing defects for 90 days from delivery, unless otherwise stated.
  • Site and products "as is": Except as expressly stated, our site, services, and products are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

10) Intellectual Property

All content on this site, including but not limited to logos, product names, graphics, photos, videos, text, designs, branding elements, and site content, is the property of Nexarina or its licensors and may not be used, copied, reproduced, modified, distributed, or exploited without prior written permission.

11) Prohibited Uses

You agree not to use the site or services for any unlawful, infringing, abusive, harmful, fraudulent, or disruptive activity, including any attempt to interfere with site security or operations.

12) Third-Party Tools & Links

We may provide access to third-party tools or link to third-party websites. These are provided for convenience only and are used at your own risk. Nexarina is not responsible for third-party content, services, or practices.

13) Force Majeure

Nexarina is not liable for delays, interruptions, or failures caused by events beyond our reasonable control, including but not limited to natural disasters, severe weather, supply chain disruptions, labor actions, customs delays, government restrictions, war, terrorism, epidemics, pandemics, utility outages, or carrier interruptions.

14) Privacy

Your submission of personal information through the site is governed by our Privacy Policy.

15) SMS Marketing & Communications

By providing your phone number and opting in to receive SMS messages from Nexarina, you consent to receive recurring marketing texts, alerts, and reminders. Message frequency varies. Standard message and data rates may apply.

You may opt out at any time by replying STOP, or request help by replying HELP. Phone numbers and SMS consent data are not shared or sold to third parties for their marketing purposes.

Carriers are not liable for delayed or undelivered messages. All SMS data is processed in accordance with our Privacy Policy.

16) Limitation of Liability

  • To the fullest extent permitted by law, Nexarina shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost savings, loss of use, emotional distress, or business interruption.
  • Our total liability for any claim relating to a product, order, or use of the site shall not exceed the amount paid for the applicable product(s) or CAD $100, whichever is greater, unless otherwise required by law.

17) Indemnification

You agree to indemnify, defend, and hold harmless Nexarina and its affiliates, directors, officers, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses arising from your breach of these Terms or your violation of any law or third-party rights.

18) Dispute Resolution & Governing Law

  • Governing Law: These Terms are governed by the laws of the Province of Alberta and the applicable laws of Canada.
  • Good-Faith Resolution: Before initiating legal action, both parties agree to first attempt to resolve any dispute informally and in good faith.
  • Arbitration: If unresolved, disputes may be submitted to binding arbitration in Edmonton, Alberta, except where prohibited by applicable consumer protection law.

19) Termination

We reserve the right to suspend, restrict, or terminate access to our site or services at any time for policy violations, suspected fraud, abuse, unlawful activity, or misuse of the site.

20) Severability & Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Failure to enforce any right or provision shall not constitute a waiver of that right or provision.

21) Entire Agreement & Updates

These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and Nexarina relating to your use of the site and your purchases. We may update these Terms from time to time, and continued use of the site constitutes acceptance of those updates.
